DailyPay Cash Back Program Terms & Conditions
By using this service you acknowledge and agree to these DailyPay, Inc. (“DailyPay”) Cash Back program terms and conditions (“Terms”) and the merchant terms, as seen in your DailyPay mobile app. These Terms and the merchant terms apply to the Cash Back offers (each offer a “Merchant Offer”, or collectively, the “Merchant Offers”) listed in the DailyPay mobile app offers marketplace (the “Offers Marketplace”). These Terms provide information on how you will receive Cash Back to your DailyPay Visa® Prepaid Card account (the “Card Account”) after you make a qualifying purchase at a participating merchant (“Merchant”). These Terms may be amended from time to time. DailyPay may terminate the Cash Back program at any time at its sole discretion. Your continued use of Cash Back signifies your acceptance of any subsequent modifications to these Terms.
Each Merchant Offer listed in your mobile app will include its own set of terms and conditions, which provide more information on the details of that Merchant Offer in the Offers Marketplace. The Merchant Offers in the Offers Marketplace are sourced and provided by our third-party service provider, who is responsible for identifying qualifying purchases and the qualifying spend for each purchase. This transaction information is then communicated to DailyPay securely so that DailyPay may deliver Cash Back rewards to eligible users.
The terms governing Merchant Offers are determined and provided by our third-party service provider, and Cash Back is provided by DailyPay according to those terms. By signing up or participating in this Cash Back program, you acknowledge and consent to your transaction and card-related data being shared with our third-party service provider for purposes of facilitating the program. If our third-party service provider is not able to validate a purchase, or if you return, modify or cancel a purchase, neither DailyPay nor our third-party service provider will have any obligation to provide any Cash Back reward for that purchase.
Cash Back rewards are solely for the benefit of the owner of the Card Account. Merchant Offers are solely for promotional purposes and cannot be sold, purchased or exchanged for cash or other valuable consideration. These Terms govern the DailyPay cardholder experience, including how DailyPay cardholders receive Cash Back to their Card Account.
Participation in the Merchant Offers is subject to these Terms and is subject to the Governing Law and Arbitration provisions of the agreement governing the Card Account (known as the “Cardholder Agreement”), and those specific sections of that agreement are incorporated into these Terms by reference.
PARTICIPATION
Eligible DailyPay users have the option of participating in the Cash Back program. To participate, you need to opt in to the Cash Back program in the DailyPay mobile app. If you are opted in, you will see Merchant Offers in the Offer Marketplace in the DailyPay mobile app. If you are not opted in, you will not have access to any offers in the DailyPay mobile app. If you wish to opt out of the program after opting in, you need to reach out to DailyPay support at (833) 998-2449 from within the U.S., or (801) 559-3868 from an international location. Fees may apply for international calls. If you opt out of the program, you will no longer be eligible to receive Cash Back. If you earned Cash Back prior to opting out of the program, you will still be paid out for those earned rewards. You are able to opt back into the program at any time in the DailyPay mobile app. Any purchases made when you are not opted into the Cash Back program will not be eligible for a Cash Back reward.
OFFER SUMMARY
Active Card Account holders may participate in a Merchant Offer by: (1) opting into the Cash Back program within the DailyPay mobile app; and (2) swiping, inserting or tapping to pay with their physical DailyPay Card or making a purchase using a digital wallet, such as Apple Pay®, Google Pay™ or Samsung Pay®, at the Merchant’s point-of-sale (“POS”) device to make a qualifying purchase within the period of time specified in the terms for the Merchant Offer in the Offer Marketplace. If permitted by the Merchant, the Card Account holder may also provide their virtual card information to the Merchant to make a qualifying purchase.
The ability to earn Cash Back for each Merchant Offer expires within the time period specified in the Offers Marketplace. You may earn Cash Back as long as your Card Account is open and in good standing and DailyPay continues to offer Cash Back. You will not be eligible to earn Cash Back rewards if your Card Account is closed or suspended for any reason.
You agree to receive notice by email, in-app banner, or push notification of relevant offers.
QUALIFYING PURCHASES
Please refer to the merchant terms in the Offers Marketplace for full details on qualifying purchases. Terms for the same merchant and/or same transactions may vary from offer to offer. Some restrictions apply. Kard is solely responsible for identifying qualifying purchases.
EARNING CASH BACK REWARDS
Please refer to the merchant terms in the Offers Marketplace for full details. While there is no DailyPay-specific cap on the amount of Cash Back rewards that you may earn by participating in Cash Back offers program, there may be exclusions and/or caps on qualifying purchases per Merchant Offer as determined by Kard and/or Merchants. If an eligible purchase is returned or disputed prior to the settlement date, you will not be eligible to receive Cash Back. For split purchases, i.e., purchases made using a DailyPay Card and another payment method, with a portion of the purchase allocated to each, only the amount settled to the DailyPay Card is eligible for a Cash Back reward.
WHEN YOU WILL RECEIVE CASH BACK REWARDS
DailyPay transfers Cash Back rewards to users’ Card Accounts on a monthly basis. Cash Back rewards earned on qualifying purchases will generally be transferred to your Card Account within 49 days after the qualifying purchase is settled. Settlement typically occurs 1-3 days after a purchase is made. Once any earned Cash Back rewards are transferred to your Card Account, they will be available for use, subject to the terms and conditions of your Card Account. The Cash Back rewards you earn on qualifying purchases will show in the transaction history view within your DailyPay app and on your monthly Card Account statements.

EXPIRATION AND FORFEITURE
Earned Cash Back rewards do not expire. If you close your Card Account, any earned Cash Back rewards not yet transferred to your Card Account will be forfeited. If your Card Account is suspended or closed for any reason, including fraud or misuse, any earned Cash Back rewards not yet transferred to your Card Account will be forfeited and you will no longer be able to participate in the Cash Back program.
REQUIRED PAYMENT OF CASH BACK REWARDS BY DAILYPAY
DailyPay will transfer to Card Accounts or otherwise transfer to users all outstanding earned Cash Back rewards if (a) DailyPay terminates the DailyPay Card program or the Cash Back program; (b) if a user opts out of the Cash Back program; or (c) if a user’s physical card is lost, stolen, compromised or expires. A user will not have to opt back in to the Cash Back program in order to receive the Cash Back that was earned on their lost, stolen, compromised or expired card.
CASH BACK REWARDS ADJUSTMENTS
DailyPay reserves the right to make adjustments to your Cash Back rewards as the result of canceled transactions, fraudulent transactions, refunds or other credits from merchants, and other credits to your Card Account (including those resulting from successful transaction disputes). If DailyPay determines that an adjustment is required due to a canceled transaction, fraudulent transaction, refund or other credit from the merchant, or other credit to your Card Account, the previously awarded Cash Back reward(s) will be deducted from your Card Account. Adjustments may cause a negative balance in your Card Account, in the event that the amount in your Card Account is less than the amount of the required adjustment. If an adjustment is made, it will be shown in the DailyPay app as a negative Cash Back rewards amount. Please refer to your Cardholder Agreement for information on how a negative balance in your Card Account is addressed.
OTHER CONDITIONS
DailyPay reserves the right to terminate the Cash Back program, or terminate eligibility in compliance with these Terms, at any time with or without prior notice. You acknowledge that the Merchant Offers in the Offers Marketplace are promotional offers for which no consideration has been paid and that the Merchant Offers have no cash value. Unless and until the Cash Back rewards are transferred to your Card Account, no tangible or intangible right, title, or interest in the Cash Back rewards has been earned. Nothing herein requires DailyPay to transfer any Cash Back rewards to your Card Account if the Merchant Offer has been canceled, terminated, or suspended at the time of your purchase. DailyPay reserves the right to change these Terms at any time in its sole discretion.
